Dear Friends,

Please accept my humble obeisances. All Glories to Srila Prabhupada.

In 1999 the devotees in Kazkhstan purchased a beautiful farm outside of the city of Almaty, Kazakhstan. Since that time substantial strides have been made in creating an agricultural community, a home for many vaisnavas, and the venue for a wonderful summer yearly festival attended by devotees from Central Asia and Russia.

Since October 2004 there have been many attempts from the government of Kazakhstan to push us from this property. This has been done by smear campaigns in the media and ongoing litigation in the courts.

On March 29, 2006 a case was conducted in the Almaty Oblast Court. Prior to issuing the ruling the judge declared that the legal arguments of the government land agency had no substance and that the arguments presented by the advocates representing our society were correct and in accordance to the Kazakhstan legal code.

But after private discussion in their chambers the judges emerged and issued a ruling against

our society in which it is stated that the land be confiscated and returned to the government. This ruling was illegal and not based on legislation of the government of Kazakhstan.

We purchased the land at the market value in 1999. In 2004 we privatised the land according to the laws of Kazakhstan in. Since this time the value of this land has increased dramatically. The situation we have is that the powerful government land barons want to eliminate us by any illegal process that they may possess the land, again sell, and make astronomical profit.

We have neither time nor options left. Our last option is the Supreme Court of Kazakhstan, but need-less-to-say, the legal system does not work in this country. It is either a matter of paying for the decision or having a powerful person order the decision.

Thus we are requesting devotees throughout the world to assist us in different ways:

First, we are requesting you to send this letter to all the contacts you have.

Second, we are requesting you to print the following letter and send to the Administration of the President of Kazakhstan requesting him to intervene in this case.

Third, we are requesting you to contact the heads of religious organisations, as well as the foreign ministries in your countries, and register an appeal that they will voice concern to the government of Kazakhstan.

And at last, we are humbly requesting that you will all pray that this situation may be reversed and our farm, Sri Vrindavan Dham, will not be stolen by the government of Kazakhstan.

The President of Kazakhstan has gained international respect for having hosted an international religious forum in 2003. Yet, despite the talks of religious equality and openness, he is allowing a religious society to be illegally evicted from their legally acquired property. It is an injustice performed in the name of religious equality.

Mr. President, you want that your fine country come into the rank of the leading nations of the world. You have shown your open mindedness by conducting your International Religious Forum in 2003. Yet in this case we have a glaring example of a religious society being destroyed by greedy and self motivated officers of your government.

Sir, we are respectfully appealing to you to intervene in this case. Please stop the abuse and destruction of the one element of Indian religion which is active in your nation. Please allow these people to live peacefully on their property in accordance to the vision of religious equality that you have presented for the nation of Kazakhstan.

Dear Devotees,

We have already informed you of the difficult situation with the farm community of the Society for KC in Kazakhstan. The government tries to evict the devotees from the land lawfully purchased in 1999 and their houses and ashramas wich accomodate more than 60 devotees. This persecution started a few years ago, but now the situation reached its critical point.

Yesterday, on April 24, at 10 p.m. the legal executive (court officer) delivered a notification to the members of the community that today, on April 25, at 11 a.m. their ashramas and cottages shall be demolished according to the decision of the court.

We ask you to help us in this difficult situation and stop the execution of the unlawful decision of the court about the demolition of the ashramas and the eviction of the devotees from their homes. All the devotees are law-obedient citizens of the Republic of Kazakhstan, and now the government wants to make them homeless outcasts.

You can help us by making telephone calls to the Administration of the President of RK, the Presidential Committee on Religious Affairs and the local administrative bodies, and requesting them to stop the execution of the unlawful decision.

A. Law-obedient citizens are deprived of their homes and thrown to the street. All of them have lawfully acquired the right of ownership for their plots of land, they have paid all the taxes and membership charges.

B. The Hakim (Governor) of the district accuses the owners that they never had their property privatized. However the members of the community repeatedly applied to the Hakim for his permission to make the acts of ownership for their cottages and plots but he repeatedly refused. Without his sanction for privatization one cannot make needed documentation for the cottages.

C. The devotees' houses are located on the territory of a Consumers Cooperative. There are 120 members of this Cooperative. However the claims are brought only against the members of the religious society. In each and every claim the connection of the defendants to the Religious Organization Society for Krishna Consciousness has been illustrated. This is a direct and flagrant violation of human rights and freedoms which are guaranteed by the Constitution of Kazakhstan.

4) Confiscation of property without compensation is possible only in a criminal case. Ours is a civil case. It is not a criminal case.

5) According to the law, the citizens whose property is confiscated are given at least 5 days to prepare for the execution of the court decision. In our case we have another transgression of the law as we were given less than one day.

Please act quickly and contact as many devotees as possible who may not be able to received this message in time.

By now, most of you have received earlier e-mails describing the situation in Kazakhstan's ISKCON community, Sri Vrindavana Dhama/Palace of the Soul.

In brief, the local court has passed an illegal ordinance, enforcing the governments repossession and destruction of land legally purchased by ISKCON and privatised through government approved means.

People are losing theirhomes, their livelihood, their possesions, and their dignity. This is an embarrasing and pronounced violation of human and religious rights.

In this footage, you will see the residents of Sri Vrindavana Dhama/Palace of the Soul peacefully protesting while they are attacked, harrassed, and assaulted by police and court officials and while bulldozers roll onto their property to destroy their homes.

This must end. We must all get involved and we must do it now.

(1) Contact your local branch of Amnesty International ( http://www.amnestyusa.org or www.amnesty.org ) and describe the situation to them. Ask what can be done and speak with their advisors to determine how to take, and inspire, action for restoration of the Kazakhstan devotees' religious and human rights.

(2) See the below list of telephone and fax numbers and make an endeavour to contact the government of Kazakhstan and its associated branches, to voice your protest. The numbers are often difficult to get through to. Keep trying! When you do get through, INSIST on speaking to someone who speaks fluent English (unless, of course, you are fluent in Russian or Kazakhstani).

Sir, we have been informed that you will be visiting Kazakhstan in the near future. We am requesting that you will help to stop the persecution which is taking place.

Please help the faithful followers of Hinduism to be able to live upon thier own property and practice thier religion with freedom of conscience.

Since I last communicated with you all there has been no change on our situation here in Kazakhstan.

On Wednesday 24 May there was an ordered television report. I will attach a transcript of the interview. In the interview a government officer described us as "wolves in sheeps clothing."

A team of devotees from Europe and America has pulled together to discuss strategy for the Kazakhstan campaign.

The team consists of Anuttama Prabhu, Saunaka Rsi prabhu, Gauri and Romapada Prabhus, Sivarama Maharaja, and myself. We have been having discussions to develop our presentation for government agencies, religious, and human rights organisations.

AT THIS MOMENT THERE IS AN IMPORTANT WAY IN WHICH YOU CAN HELP US:

Kazakhstan wishes to become the Chairman of OSCE in 2009. Thus the Kazakh government is hosting an OSCE conference in Kazakhstan on June 12-13, 2006.

Prior to the event we want to create an international awareness of our issue so that it will be discussed during this important conference.

PLEASE HELP WITH THE FOLLOWING POINTS:

1. We are requesting that you look at the three documents that I will attach.

a. Appeal letter
b. Chronology
c. Legal Injustice Brief

2. Next we are requesting that you will fax and email those three documents to Vienna, Austria to the OSCE Ambassador who represents your country.

3. We are also requesting you to fax and email these documents to the OSCE offices in your respective countries. I have attached a list of member nations of OSCE. You will have to search their email and fax address within your country. Then please send it to the appropriate person.

The Karasai Hindus were informed to come to the capital of Kazakhstan to participate in the beginning of the commission established to resolve (to investigate) the land issues surrounding the Religious Organization Society for Krishna Consciousness in Karasai Rayon.

That was Thursday September 7, 2006, 5 days prior to the international religious congress.

Since we were informed that the meeting would deal with land issues we informed the commission that we would bring our advocates. The head of the commission very angrily objected to this. Being advised by human rights observers we took our advocates and they were accepted.

We also requested three respected human rights observers to participate, Ninel Fokina from Helsinki Human Rights, Evgeniy Zhovtis from the International Bureau on Human Rights, and Lisa Zumahmetova from OSCE.

We were informed that Moslem and Orthodox Christian Cleric would attend the meeting (will be members of the commission). We found this highly irregular as the purpose of the meeting was to deal with "Economic Issues." The human rights specialists advised that the cleric not attend our meeting but the government insisted.

The meeting was conducted and the chairmanship was given to Mr. A.M. Muhkashov, the deputy director of the Kazakh government Religion Committee, which works under the Department of Justice. The Hindus have been appealing to Mr. Mukhashov for many years to help the situation and he has done nothing. And the result of the religious committee was to make this person chairman. (And Religious Committee decided Muhashov to be a chairman of the commission?.)

The decision of the first meeting was that the advocates for the Karasai Hakim and the Hindus would present a legal brief to all of the members of the commission and, a week after receiving and thoroughly studying the documents, the members would come to Almaty to observe the situation.

The documents were submitted on Friday September 22, 2006 and on Monday we were informed that the commission was coming to Almaty.

The first meeting was conducted at 11 AM on Thursday September 28, 2006 at the Karasai Rayon Hakimat. When we arrived the workers in the office said they did not know about any commission. When we were waiting a Christian Priest arrived and said hello, I don't know why I am here but I was ordered to come.

Mr. Mukhashov arrived at 11:30 AM. We were shown to a room full of local workers from the Hakimat who had no idea what was taking place. There were no other members of the commission from Astana, or Almaty State Government present. Only, Mr. Muhkashov.

The outline of the session was that there would be two meetings in the Hakimat, on Sunday there would be an official visit to the farm, and on Monday a result of the session would be announced.

It was literally 4 days of madness. If anyone spoke in favour of the Hindus it was labelled propaganda. If the advocates of the Hindus attempted to present the case according to the legal codes of Kazakhstan it was ruled a diversion from the subject.

Both Moslem and Christian cleric spoke and clearly said that the Hindus do not have a place in Kazakhstan.

On the day the government commission visited the farm they (Hakimat) brought 4 Kazakh television channels and bussed in unrelated villagers to scream in front of the cameras. The entire farm was surrounded by police division.

When I asked the chairman of the commission who had given permission for the TV and bussed in people he replied, "I did, so what?" All interviews against the Hindus were filmed. But when Hindus and local people who support the Hindus spoke, the media was sent away.

The next day Monday October 2, 2006 there was a concluding meeting of the commission in Karasai District Hakimat. A that time a document was read that was prepared by the Chairman of the commission and officer of the land committee. The essence of the statement is that there has been an investigation and there is no sign of religious discrimination. (There was never round table arranged to discuss the issue, members of the commission were not present at the sessions in Karasai District, consequently the final decision was made without members of the commission developing and working on it).

The entire commission was observed by 3 human rights observers. Thier perspective on the situation with Hindus vastly differs from the final conclusion of the Chairman. Being present on the sessions of the commission they consider the commission itself and the way it was conducted, to be an obvious demonstration of religious discrimination. They will prepare a statement on this issue.

On October 9, 10, 11, 2006 representatives of the Hindus attended an OSCE/ODIHR meeting in Warsaw to present the case to the advisory council of the Human Dimensions division of OSCE. The advisory council is considering taking up the matter as a human rights issue.

After a presentation which was made by Helsinki Human Rights Kazakhstan, in which the plight of religious organisations in Kazakhstan was explained, a video was presented on the issue of the Hindus of Karasai district.

The Hindus afterwards met with the chief Omsbudman of the Kazakhstan Government, who is a commisioner on human rights.

He kindly expressed that the issue was not a matter of religious discrimination but rather a very sophisticated land grab being enacted by the "rich and powerful."

With respect to his opinion the Hindu leaders explained:

that it is the Kazakh government which has selectively brought all cases against the Hindus, that it is the government that has indicated the religious affiliation of the plaintiff in all cases,

it is the government that has demanded certificates that one is not a Hindu in order to get privatization,

it is government officials who openly denigrates the Hindu religion on TV and newspapers of Kazakhstan.

it is the judiciary that indicates in all of its rulings that the rulings are being made against Hindus.

it was the judiciary that conducted Supreme Court cases without informing the plaintiffs.

The omsbud official had no comment to make.

In a side meeting with another officer from Kazakhstan we were advised, "I have a feeling that your case has already been decided in Kazakhstan, you will get no justice in Kazakhstan, and your only salvation will be international intervention."

Now it has been one month since the "Commission" and we are unable to get the minutes or "protocol" of the commission. When we made a request for the minutes and the official decision of the commission we were told by the chairman of the commission," what do you need that for."

On November 20, 2006 at 6 AM an unidentified person delivered a stack of orders from the Executors of the Karasai District Court. The orders stated that the owners of cottages must destroy thier homes, or they will be destroyed by the government at the expense of the owners.

24 hours later 3 busses full of riot police, 2 ambulances, 2 empty lorries, and executors of Karasai district arrived at the Hindus farm to destroy thier homes and personal temples.

They have strictly cordoned off the area to prevent journalists, human rights observers, and congregation from entering the area.

As of 16:25 (4:25 PM) they have destroyed three homes and broken out the window of all of the hindus home. At the present it is snowing and is subzero weather.

When I last communicated with Kazakhstan the officials were destroying the home of one mother and her newly born infant daughter. Her husband was not present as he was in Almaty.

The Chairman of the Commission that was established to work on the issue, Amanbek Mukhashov, was phoned from India. When he was question he simply closed the telephone call.

Mr. Yerlan and Mr. Tulesov, of the Religion committee, have both recently made statements that the work of the commission is still in progress. They both said they had no idea what was happening.

In India the Kazakhstan Ambassador, Mr. Umarov, could only repeat the incorrect information which he has recieved from the Kazakhstan central government.

The president of Kazakhstan, Nursultan Nazarbayev, is at the present moment in England seeking economic investment for his country.

This attack is a follow up to foiled attempt to destroy homes in April 2006. The result of that action was international outcry regarding the disregard of human rights of the Kazakh government.

The acts constitute religious discrimination against a minority religion in Kazakhstan, as well as a collusion of the local government with the land mafia of Kazakhstan.

The issue is under observation by OSCE and International Human rights organisations.

We are requesting concerned persons around the world to appeal to your foreign ministry to take up this issue with the Kazakh government.

As of sending this letter, two more home have been destroyed, including the home of one elderly devotee lady who has a retarded son, and no other place to go.

In all 11 homes were destroyed today by the Kazakh Government.

They cut the electric cable at the farm. Thus there is no light, heat, or water for the devotees.

Ninel Fokina of Helsinki Human Rights said the behaviour of the people was less than human. They apparently were given an order from above and they were adamant to execute the order.

Devotees have relocated and cramped into apartments in the nearby village.

The Kazakh government has taken a paradise and turned it into a hell.

Tonight we were on India TV.

Also today our documents were recieved at 10 Downing Street to be presented to Tony Blair. He has agreed to bring up the issue when he meets Nazarbayev today.

Tomorrow there will be demonstrations at the London Stock Exchange when Nazarbayev visits there in the morning.

We have many devotees without homes and it is snowing tonight in Kazakhstan.

OSCE Statement
Stop OSCE Chairman Kazakstan

Send the attched documents to the whomever the OSCE foreign minister for your particular nation may be.

THIS COMING MONDAY AND TUESDAY THE OSCE WILL BE HAVING A MEETING TO DETERMINE IF KAZAKHSTAN WILL BE THE CHAIRMAN OF THEIR ORGANSIATION IN 2009.

THUS ALL COUNTRIES MUST PUSH THE DOCUMENTS TO THIER FOREIGN MINISTRIES AND TO THIER COUNTRIES REPRESENTATIVES TO OSCE PRIOR TO THAT TIME.

IN THE UK THE FOREIGN MINISTER HAS AGREED TO BRING UP THIS ISSUE OF HUMAN RIGHTS ABUSE TO THE KAZAKH GOVERNMENT WHEN THEY MEET NEXT WEEK. BUT, WE NEED COUNTRIES FROM ALL OVER THE WORLD TO DO THE SAME.

IF YOU CAN GET HINDU ORGANISATIONS IN YOUR NATION TO SEND THIS LETTER THROUGH IT WILL BE MUCH MORE POWERFUL.

EVERYONE PLEASE HELP TO CONTACT THE OSCE FOREIGN MINISTERS AND YOUR NATIONS FOREIGN MINISTERS AT THIS TIME.
